- How long does a mutual consent divorce take?
- There are two motions, separated by a statutory cooling-off period of six months, which courts may waive in appropriate cases. Where terms are agreed at the outset, the process is usually the fastest available route.
- Can proceedings continue if one spouse lives abroad?
- Yes. Appearance can often be managed through counsel and, where the court permits, video conferencing, though personal appearance is required at certain stages in matrimonial matters.
- Is a will required to be registered?
- Registration is optional, but it reduces the scope for later dispute about authenticity. A will must be properly executed and attested to be valid.
- How is child custody decided?
- The welfare of the child is the paramount consideration. Courts weigh stability, schooling, the child's wishes where age-appropriate, and each parent's ability to provide care.
