Frequently asked questions

Can the six-month cooling-off period be waived?
Courts have discretion to waive the statutory waiting period in mutual consent matters where the parties have been separated for a substantial period and reconciliation is not possible. Waiver is not automatic and must be applied for.
Which court hears the petition?
Generally the family court where the marriage was solemnised, where the parties last resided together, or where the respondent resides. Where more than one court has jurisdiction, the choice can matter tactically.
Does maintenance depend on who filed the petition?
No. Maintenance is assessed on need, the earning capacity of both parties and the standard of living during the marriage, not on who initiated proceedings.
Are proceedings confidential?
Family court proceedings are conducted with restricted access, and settlement terms can be recorded without unnecessary public detail.
