Frequently asked questions

How long does trade mark registration take in India?
An unopposed application that clears examination without objection commonly takes several months to a year. Objections or oppositions extend this considerably. The application number and priority date, however, are secured on the day of filing.
Can I use the ™ symbol before registration?
Yes. ™ may be used from filing or from use of the mark. The ® symbol may only be used once the mark is registered.
What happens if the Registry raises an objection?
We file a written reply addressing the grounds — commonly descriptiveness under section 9 or a conflicting earlier mark under section 11 — supported by evidence of use or distinctiveness, and attend the hearing if one is fixed.
How long does a registration last?
Ten years from the date of application, renewable in successive ten-year terms. We maintain a renewal diary for marks we file.
