- Is there a time limit for filing a motor accident claim?
- The Motor Vehicles Act as amended does not prescribe the earlier limitation bar in the same terms, but claims should be filed promptly — evidence deteriorates and delay invites challenge. The current position should be checked on the facts of your case before filing.
- How is compensation calculated?
- For injury, on medical expenses actually incurred, loss of income during treatment, future loss of earning capacity and non-pecuniary heads. In fatal cases, on the deceased's income, a multiplier based on age, deductions for personal expenses, and conventional heads.
- What if the offending vehicle was uninsured or untraced?
- Claims may lie against the owner and driver personally, and statutory schemes provide limited compensation in hit-and-run cases. We advise on which route applies.
- Do I need to attend the Tribunal personally?
- The claimant's evidence generally requires personal appearance, but not every hearing does. We minimise the number of attendances required.
